Distracted Driving Lawsuits
Injured by a careless driver? You have rights.
Distracted driving is responsible for thousands of accidents and deaths in the United States every year. Texting / cellphone use is by far the most prominent form of distraction, but reading, eating, and inattention are responsible for a startling number of accident as well. If you suffered an injury because another driver wasn't paying attention, you have the right to seek financial compensation for your injuries, missed wages, etc.
Understanding Driver Distraction
There are three basic types of distraction: manual, cognitive, and visual. Some distractions, such as texting behind the wheel, encompass all three of these categories.
-
Manual Distractions
A manual distraction is anything that takes the driver's hands off of the wheel. Eating or adjusting the radio, for example, are common forms of manual distraction.
-
Visual Distractions
Glancing at a GIPS device, watching a video on your phone, or reading behind the wheel are all visual distractions (distractions that take your eyes away from the road).
-
Cognitive Distractions
This type of distraction includes anything that detracts from the driver's ability to concentrate on the road. Talking on the phone (even a hand-free device) is a cognitive distraction.
Texting While Driving Lawsuits
Texting while driving may be the most severe form of driver distraction. Not only does it take the drivers eyes and mind off of the road, but it requires the drive to remove his / her hands from the steering wheel. Additionally, texting is unlawful. If you suffered an injury because another driver was texting and driving, you have the right to seek financial compensation for your damages.
